St.Maarten/St.Martin - February 5th 2011 RAID
On Saturday, February 5th 2011 a raid has taken place on the island of St.Maarten (Dutch side).
Our Caribbean law firm partner : James Martin & Associates was granted permission by the court for preliminary seizure for alleged Tm infringement at several locations.
All the islands court Bailiffs (court processors) were participating in this raid, the public prosecutor office was informed timely of the civil action, to prevent traffic chaos or public disorder. Quantity wise it was such a success that actually not all locations could be done that were scheduled for that day. Therefore the remaining locations will be receiving visits from various bailiffs in some weeks to come.
It was estimated that around 60m3 was seized between10:00am and 15:00pm, when we were still packing, labeling and counting the merchandise.
All locations that were visited with the exception of one store have ceased and desist/settled with the law firm. All Tm participants in this raid will be receiving reports on amounts and pictures are to be supplied. As the raid will now continue spread out over some weeks , you will receive additional data when it comes available.
